1. Quiénes somos
El servicio lo presta Webcamaya LLC («nosotros»). Al instalar, activar o usar W-WhatsApp, W-SMS o W-Llamadas («el servicio») usted («el cliente») acepta estos términos. Si los acepta en nombre de una empresa, declara que puede obligarla.
2. Qué es el servicio
- W-WhatsApp: conecta hasta 5 números de WhatsApp por cuenta del CRM, por código QR o por código de 8 letras, para recibir y contestar mensajes desde Conversaciones.
- W-SMS: envía y recibe SMS por un teléfono Android del cliente con nuestra app W-SMS instalada. Los SMS los cobra su compañía telefónica según su plan.
- W-Llamadas (BETA): llamar y contestar llamadas de WhatsApp desde la computadora. Es una función en pruebas: puede fallar, cambiar o dejar de funcionar sin aviso, sobre todo si WhatsApp cambia su sistema. Solo para clientes directos de Webcamaya: no se incluye en la app del Marketplace del CRM.
3. Sus responsabilidades
- Usted es el único responsable de su número de WhatsApp y del teléfono Android que conecte, y de lo que se envíe desde ellos.
- Debe tener el permiso de sus contactos para escribirles y llamarles, y respetar cuando le pidan que no lo haga más.
- Debe cumplir las leyes que le apliquen (por ejemplo, en EE. UU., la TCPA y las leyes de cada estado sobre mensajes, llamadas y telemercadeo) y las condiciones de uso de WhatsApp.
- No puede usar el servicio para nada ilegal, engañoso, de acoso o que infrinja derechos de otros.
- Debe mantener seguros sus accesos y avisarnos si alguien entra sin permiso.
4. Envíos a goteo y límites
Los mensajes salen uno por uno con una pausa entre cada uno. No se puede desactivar. Podemos fijar límites de uso, de números conectados o de llamadas a la vez para que el servicio funcione bien para todos. Si detectamos envíos masivos o spam, podemos pausar o cancelar su cuenta sin reembolso.
5. Grabación de llamadas (solo W-Llamadas)
Si activa la grabación de llamadas, usted es responsable de cumplir las leyes de su estado o país sobre avisar o pedir permiso para grabar. En varios estados de EE. UU. (por ejemplo, Florida y California) todas las personas de la llamada deben estar de acuerdo. Las grabaciones se guardan 90 días y después se borran.
6. Precio, prueba gratis y cancelación
- W-WhatsApp: $19 al mes por cuenta, con W-SMS (beta) incluido.
- Descuento por volumen: −20 % desde 10 cuentas y −35 % desde 50 cuentas.
- 7 días gratis la primera vez. Si no cancela antes de que termine la prueba, empieza el cobro mensual.
- Puede cancelar cuando quiera; sigue funcionando hasta el final del mes ya pagado. No devolvemos meses ya empezados, salvo que la ley lo exija.
- Si el pago falla, podemos pausar el servicio hasta que se pague.
- El servicio no incluye el CRM ni el saldo de SMS de su compañía telefónica.
7. Lo que no garantizamos
El servicio se da «tal cual» y «según disponibilidad». No garantizamos que funcione sin cortes, que WhatsApp no bloquee un número, que lleguen todos los mensajes o llamadas, ni que las funciones sigan iguales si WhatsApp, el CRM o Android cambian. Usted debe tener otra forma de contactar a sus clientes por si el servicio falla.
8. Límite de responsabilidad
En la medida en que la ley lo permita, no respondemos por pérdidas indirectas (clientes, ventas, datos, números bloqueados o daños de reputación). Nuestra responsabilidad total no pasará de lo que usted nos pagó en los 3 meses anteriores al problema.

10. Cambios y terminación
Podemos cambiar estos términos; si el cambio es importante, avisaremos con al menos 15 días. Podemos terminar el servicio a quien incumpla estos términos. Usted puede dejarlo cuando quiera desinstalando la app y cancelando el pago.
11. Ley aplicable
Estos términos se rigen por las leyes del Estado de Florida (EE. UU.), salvo que la ley de su país le dé derechos que no se pueden renunciar.

The service is provided by Webcamaya LLC ("we"). By installing, activating or using W-WhatsApp, W-SMS or W-Llamadas (the "service"), you (the "customer") accept these terms. If you accept on behalf of a company, you confirm you can bind it.
2. What the service is
- W-WhatsApp: connects up to 5 WhatsApp numbers per CRM account, by QR code or an 8-letter code, to receive and reply to messages from Conversations.
- W-SMS: sends and receives SMS through the customer's Android phone with our W-SMS app installed. Your carrier charges for the SMS under your plan.
- W-Llamadas (BETA): make and answer WhatsApp calls from your computer. This is a beta feature: it may fail, change or stop working without notice, especially if WhatsApp changes its system. Only for direct Webcamaya customers: it is not part of the CRM Marketplace app.
3. Your responsibilities
- You are solely responsible for your WhatsApp number and the Android phone you connect, and for everything sent from them.
- You must have your contacts' permission to message and call them, and honor opt-out requests.
- You must comply with applicable laws (for example, in the US, the TCPA and state laws on messaging, calls and telemarketing) and with WhatsApp's terms.
- You may not use the service for anything illegal, deceptive, harassing, or that infringes others' rights.
- You must keep your access secure and tell us about any unauthorized use.
4. Drip sending and limits
Messages are sent one by one with a pause between them. This cannot be turned off. We may set limits on usage, connected numbers or concurrent calls so the service works well for everyone. If we detect bulk sending or spam, we may pause or cancel your account without refund.
5. Call recording (W-Llamadas only)
If you turn on call recording, you are responsible for complying with the laws of your state or country on notice and consent. Several US states (for example, Florida and California) require consent from everyone on the call. Recordings are kept for 90 days and then deleted.
6. Price, free trial and cancellation
- W-WhatsApp: $19/month per account, W-SMS (beta) included.
- Volume discount: 20% off from 10 accounts and 35% off from 50 accounts.
- 7-day free trial the first time. If you don't cancel before the trial ends, monthly billing starts.
- You can cancel any time; the service keeps working until the end of the paid month. We do not refund months already started, unless the law requires it.
- If a payment fails, we may pause the service until it is paid.
- The service does not include the CRM or your carrier's SMS plan.
7. No warranty
The service is provided "as is" and "as available". We do not guarantee uninterrupted operation, that WhatsApp will not block a number, that every message or call is delivered, or that features stay the same if WhatsApp, the CRM or Android change. You should keep another way to reach your customers in case the service fails.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect losses (customers, sales, data, blocked numbers or reputation). Our total liability will not exceed what you paid us in the 3 months before the issue.
9. Data
How we handle data is explained in the Privacy Policy.
10. Changes and termination
We may change these terms; for material changes we will give at least 15 days' notice. We may terminate the service for anyone who breaches these terms. You may stop any time by uninstalling the app and cancelling payment.
11. Governing law
These terms are governed by the laws of the State of Florida (USA), except where your country's law grants you rights that cannot be waived.
